Vergangenheit angehören. Derzeit bieten derartige Einstellungen reichlich
Zündstoff für Diskussionen um das Antidiskriminierungsgesetz, welches
erstmals im Jahre 2001 im Bundestag thematisiert wurde und aktuell, in
mehrfach überarbeiteter Form, kurz vor der Verabschiedung steht. Hintergrund
dieses Gesetzentwurfes liegt in der Durchsetzung einer Richtlinie der
Europäischen Union, die in den Bereichen der Beschäftigung und des Berufes
zum Schutz vor Diskriminierung hinsichtlich der Merkmale Rasse und ethnische
Herkunft verpflichtet. Übertretungen dieses Gesetzes
könnten dabei die Möglichkeit einer Schadensersatzklage nach sich ziehen.
Wird ein Unternehmer künftig jedes Vorstellungsgespräch mit dem Gedanken
einer eventuell folgenden Schadensersatzklage führen und nicht vollkommen
autonom aussuchen können, wen er einstellt?
Das so oft gehörte Lied der Vertragsfreiheit würde etwas leiser spielen. Ist man
denn letztendlich wirklich so frei, selbst zu entscheiden, mit wem man bestimmte Verträge eingeht, wie man glaubt? Es besteht doch der Grundsatz
der Vertragsfreiheit. Doch was versteht man überhaupt unter genannter
Vertragsfreiheit?
Um eine Antwort auf diese Frage finden zu können, beleuchtet die vorliegende
Arbeit das Wesen der „Vertragsfreiheit“. Gegenstand soll dabei in erster Linie
ein allgemeiner Einblick in die Vertragsfreiheit mit Konzentration auf das BGBSchuldrecht
sein. Die Arbeit setzt sich aus drei Elementen zusammen:
Begonnen wird mit der Eingliederung der Vertragsfreiheit in das nationale
Rechtswesen, wobei zunächst die nationale Rechtsordnung, gefolgt von der
Privatautonomie, und später dem Vertrag dargestellt wird. Im Anschluss daran
wird die historische Entwicklung der Vertragsfreiheit anhand einer Zeitreihe, die
mit dem Antiken Rom einsetzt, über das Hochmittelalter, 19. Jahrhundert und
20. Jahrhundert bis hin zur Gegenwart langt, aufgezeigt. Der dritte Teil der
Arbeit legt seinen Schwerpunkt auf die einzelnen Komponenten der
Vertragsfreiheit, die jeweils in ihrer Dogmatik sowie in ihren Grenzen im
nationalen Recht nach hierarchischer Anordnung erläutert werden.
Abschließend wird in Form einer Zusammenfassung ein Überblick der Thematik
verschafft, bevor letztendlich ein Ausblick die Arbeit beschließt.
